FOR THE SALE TODAY, THE SUCCESSFUL BIDDER WILL BE REQUIRED TO PAY AS EARNEST MONEY A SUM OF NOT LESS THAN FIFTEEN (15%) PERCENT OF THE TOTAL BID PRICE. 

THIS PROPERTY IS BEING SOLD SUBJECT TO THE RIGHT OF ANY PERSON TO RAISE THE BID ON THIS PROPERTY BY TEN (10%) PERCENT OF THE FINAL BID PRICE WITHIN TEN (10) DAYS FROM TODAY’S DATE.

IN THE EVENT THE BID IS RAISED TEN (10%) PERCENT WITHIN TEN (10) DAYS, NOTICE WILL BE GIVEN TO THE PURCHASER OF THE SALE TODAY. THE CLERK AND MASTER WILL SCHEDULE AND NOTIFY ALL INTERESTED BIDDERS OF THE DATE AND TIME FOR A SECOND AND FINAL SALE, WHICH WILL BE HELD AT THE COURTHOUSE. UPON COMPLETION OF THE SECOND SALE, THE BID AT THAT TIME WILL BECOME FINAL AND THE PROPERTY WILL NOT BE SUBJECT TO ANY ADDITIONAL RAISE.

IN THE EVENT THAT THE BID TODAY IS RAISED WITHIN TEN (10) DAYS AND AFTER COMPLETION OF THE SECOND SALE, ANY EARNEST MONEY PAID IN BY A NON-BUYER WILL BE REFUNDED TO THEM AS SOON AS FEASIBLY POSSIBLE.

IN THE EVENT THE BID IS NOT RAISED WITHIN TEN (10) DAYS, THE BIDDER WILL BE NOTIFIED THAT HIS/HER BID HAS BECOME FINAL. THE PURCHASER SHALL PAY THE BALANCE UPON DELIVERY OF THE DEED.

IN THE EVENT THAT A SUCCESSFUL BIDDER FAILS AND REFUSES TO PAY THE BALANCE OF THE PURCHASE PRICE, THEN THE AMOUNT OF DEPOSIT WILL BE HELD UNTIL SUCH TIME AS THE CHANCELLOR SHALL DETERMINE WHAT COSTS AND DAMAGES, IF ANY, SHALL BE PAID FROM THE MONEY DEPOSITED IN ESCROW.
